Libertarian Party applauds DOMA strikedown

The Libertarian Party applauds the U.S. Supreme Court’s decision today to strike the Defense of Marriage Act (DOMA), a federal law that discriminates against non-heterosexual marriages.
The Libertarian Party has supported marriage equality since its founding in 1971.
"The Republican Party has never supported marriage equality," said Laura Delhomme, 2013 Libertarian candidate for delegate in Virginia. "Democrats, despite their alleged support of civil liberties, only added a reference to same-sex marriage to their party platform in 2012 — when it became politically convenient."
DOMA was pushed through by a GOP-led Congress and signed by a Democratic president.
"This is a landmark victory for personal freedom," said Geoffrey J. Neale, chair of the Libertarian National Committee. "The Democrats and Republicans who have advanced, defended, and let stand government intrusion into the private contracts and choices of consenting adults will be remembered for their inhumanity on this issue."
Ending DOMA means that the federal government will recognize the legal marriages of same-sex couples in states that recognize marriage equality. This is a good first step toward ending government discrimination that has affected millions of Americans.
Libertarian candidates have long rallied for marriage equality. This year, Robert Sarvis, Libertarian Party of Virginia candidate for governor, along with Delhomme and several other candidates for legislature, have vowed to press for recognition of same-sex marriage in Virginia.
Libertarian candidates in New Jersey, the only other state that is holding legislative races this year, are also calling for marriage equality.
"Same-sex couples are denied the right to marry because the governor vetoed the marriage equality bill that would have guaranteed their civil rights," said Ken Kaplan, Libertarian for governor in New Jersey. "I will sign such a bill."
The Libertarian Party platform states that "Sexual orientation, preference, gender, or gender identity should have no impact on the government's treatment of individuals, such as in current marriage, child custody, adoption, immigration or military service laws."
A recent poll from ABC News/Washington Post shows that 58 percent of Americans support marriage equality, a rapid change from just a decade ago, when only 39 percent supported it. Americans are coming around to the Libertarian view that big government does not belong in our lives, whether it’s our bedrooms or our wallets.

LP fights unfair ballot access laws in four states

The Libertarian Party has been forced to fight for fairer ballot access laws for more than four decades, and has successfully done so in many states, playing a key role in improving their ballot access laws. Many detrimental laws still exist, though, and some states have made these laws considerably worse during the last few years.
State laws, rather than federal laws, have complete control over ballot access laws, so their fairness varies widely throughout the United States. This diversity between states can make it easier to affect any particular law, but it also means that the United States, almost uniquely among countries that have the reputation of holding free elections, has many laws that make it difficult for any party other than the those of the Democrats and Republicans to place its nominees on the ballot.
The Libertarian Party is currently fighting for fairer ballot access in a four states.

Newsmax: Libertarians See Political Gains in NSA Leak Debacle
From a June 11 Newsmax article which features the reactions of 2012 LP Presidential Nominee Gov. Gary Johnson and LP Executive Director Carla Howell to news of the NSA leak:
"Hopefully, what Edward Snowden will bring about will be very healthy," Johnson said, referring to the intelligence contractor who leaked details of the program to the media.

Detroit, Mich., has been a city in decline for years, but Libertarian Scotty Boman is ready to help turn that around in his campaign for city clerk. In this position, Boman would oversee city records and elections, and his plans to increase government transparency would allow citizens to make informed decisions about how taxpayer funds are wasted and where they can make dramatic cuts to city spending.
"Transparency could prevent a lot of wasteful spending," Boman said. He pointed out that Detroit expenditures are today reported in broad strokes, lumping large sums of money into a few spending categories with only vague terminology that describes where the funds actually go.
"One piece of information that should be easy to list includes the salaries of our elected officials," Boman wrote on his campaign website. "I would make that kind of information easy to find. I would also post detailed audits, so the public would know exactly how their money is being spent."
With Libertarian oversight over city records, Boman would be able to report exactly how and where every dollar is spent. "I think that would prevent a lot of waste," he said.

We have been adding many names to our email list. This is a very good sign for the message of Liberty and we hope to have the project complete by next week. We will wait until then to formally welcome all our new readers. For now, if you are new to our list, Welcome!

Drones are receiving quite a bit of publicity lately. For good reason.

Drones are an amazing feat of human technology with immense potential. They can be used to aid search and rescue; to deactivate a bomb; or to drop a bomb.

Because they can be controlled remotely, they can be small ... even nano-size ... and they do not require the person controlling the drone to come into the operational area, reducing risk. We understand smart drones are now being developed that require little or no human direction.

However, for all the effort to make drones more effective, as Libertarians, we are concerned about the impact they could have on our privacy and civil liberties. We believe a bit of effort to limit or regulate their use now will prevent abuse by either government entities or private groups at some future time.

It’s important to keep in mind that we are not necessarily against the idea of domestic drones. We recognize they can be extremely helpful in certain circumstances. Law enforcement has long used helicopters, for example. 

However, a helicopter flies above us and looks down; a drone could be undetected as it peeks through our windows. They could crawl under our door. They could carry or place surveillance devices inside the most private parts of our homes. Should government agencies, law enforcement or even private organizations and individuals have this right without restriction? Can information gained be admissible in court?

We want to ensure that drones are not used to infringe on our rights. Unless Libertarians take steps now to insure responsible use of this new technology, we feel fairly certain it will be seriously abused in the not-to-distant future.

Currently, there are no laws in place to keep us from being observed by a drone or even to give us any way of knowing we are being observed. No court is required to approve a warrant for their use. There are also no guidelines in place for the use of weapons on drones. 

It conjures images from fictional works like 1984 or even The Terminator.

A group of Libertarians in Douglas County have led the way for Kansas Libertarians. They teamed up with like-minded groups on this issue and led a collation of concerned citizens to advocate for limitations on the use of drones in their county. Our Douglas County Libertarians have forged a model that can work across the state.

They gathered a coalition of supporters, created a facebook page called - Kansans for Responsible Drone Use and went to the city council to request they write a city resolution to protect citizens from having their civil liberties (privacy) violated. 

This is a formula that can work in any Kansas community and we hope it will be emulated in many. This is another area where Libertarians can make a difference. Open Carry in the Kansas City area is moving ahead at a healthy clip. 

Longtime readers will recall that Kansas law specifically permits open carry anywhere in the state. While local communities may regulate open carry, they may not prohibit it.

The LPKS open carry task force has successfully engaged a number of communities that previously had ordinances prohibiting open carry. We pointed out the state statute and after some reasonable discussions, they decided to change their local ordinances to comply with state law.

A few have not. Leawood and Prairie Village apparently want to discuss this in court. We are prepared to meet them there.

Recently, our second amendment activists held a Founding Father's Day Picnic during which a group of men, women and their children gathered in support of civil liberties. Wearing empty holsters, they were protesting the open carry bans in Leawood and Prairie Village.

We also announced that the Johnson County Open Carry Group will bring suit in those two cities in the coming weeks.

This is an on-going effort by the Libertarian Party of Kansas. It shows the results a few dedicated Libertarians can achieve. Thank you to Grant Nelson, Mike Kerner and Earl McIntosh for their courage in leading this and facing the press. 

Thanks to all the Ls in the 3rd district for support and getting the word out. It serves as an example for Ls across the state.

The Natural Law

Question: Of all political systems, why is Libertarian the best?

Answer: Because Libertarianism has the most solid moral foundation in human rights.

Libertarianism is a descendant of natural law and ethical intuitionism. Natural law is the philosophical proposition that certain rights are ordained by virtue of the human condition. In other words, because you and I are human, we are born with rights. 

The government does not give these rights any more than the government allows you and me to breathe. The government’s role is to protect these rights and not diminish them. History suggests that only small government can do this. 

Can the government take away a natural right? Practically speaking, government can place penalties on acting out natural rights. However, only elimination of the human species could theoretically vanquish forever a natural law, and maybe not even then, depending on the source of Law. 

Governments are good at suppressing rights. 

What are some of the rights derived from Natural Law? The freedom of speech, freedom of association, and freedom to defend oneself, these and others are Natural Law rights. 

Maybe they come from nature, were ingrained by evolution, perhaps revealed by divine revelation, bestowed from supernatural inspiration, or discovered by reason. 

Libertarians and others will hold different beliefs on the origin of Natural Law. But regardless of their origin, they exist. They exist within each of us, individually. 

The party that best maximizes individual liberty is most aligned with Natural Law. We know that party as Libertarianism.

Government phone, Internet snooping demands immediate, dramatic downsizing of all spy agencies, repeal of Patriot Act, FISA, NDAA
Taking its cue from George Orwell’s famous novel 1984, the Obama administration is mining customer data from major Internet vendors and collecting telephone records of millions of U.S. citizens indiscriminately — regardless of whether they are suspected of a crime.
The National Security Agency (NSA) is currently collecting the records U.S. customers of Verizon under a top secret court order issued in April. It is requiring Verizon to give the NSA information on all telephone calls in its system — and also demanding Verizon’s silence on the order.
The secret Foreign Intelligence Surveillance Court granted the order to the FBI on April 25, giving the government unlimited authority to obtain the data for a specified three-month period ending on July 19.
In addition, the Washington Post reports that the NSA and the FBI are tapping directly into the servers of nine leading U.S. Internet companies: Microsoft, Yahoo, Google, Facebook, PalTalk, AOL, Skype, YouTube, and Apple. Under a program called PRISM, they’re extracting audio and video chats, photographs, emails, documents, and connection logs that enable government analysts to trace a user’s network of associates.
“How many violations of the Bill of Rights will it take for civil libertarians to abandon their support of a president who has not only continued — but escalated — the sins of the Bush administration?” asked Geoffrey J. Neale, chair of the Libertarian Party.
The FBI/NSA’s broad surveillance of domestic calls is allegedly authorized by the Patriot Act and by 2008 reforms of the Foreign Intelligence Surveillance Act. Then–U.S. Sen. Barack Obama voted in favor of the reforms.
“Full repeal of FISA, the Patriot Act and the National Defense Authorization Act (NDAA) and massive downsizing of federal spy agencies is the only answer,” said Neale. “Not maybe. Not later. Now. This will stop the incremental yet rapid decline of our privacy and civil liberties, put a check on government power, and help to ensure that every American is afforded due process and justice if charged with a crime.”

Why don’t Democrats (and most Republicans) apologize to the American people when the stock market goes up?
When the stock market drops, count on politicians to exclaim, “Thank goodness we didn’t privatize Social Security! Just look how much people would have lost in the stock market!”
“So, after an almost uninterrupted bull market since March 2009 and six consecutive months of stock market gains, why haven’t politicians who are against any kind of privatization of Social Security apologized to the American people?” asks William Redpath, Libertarian National Committee member and a former National Chairman, who is a licensed CPA in Virginia and a Chartered Financial Analyst (CFA).
Recent reports released by the Congressional Research Service state that the Social Security “Trust Fund” will become insolvent within the next 20 years. With no accumulated assets, it relies on payroll taxes to make payments to today’s retirees.
“More than two thirds of workers pay more in payroll taxes than the individual income tax. That is money that is forcibly taken from them by the government that they could invest to build real wealth over the course of their working lives, or money that could be spent to make their lives better today. Instead, workers are forced into a system in which their payroll taxes are immediately given to current retirees or spent by the government in other ways.
“People should be free to keep their payroll taxes and use those funds as they see fit. If they choose to save and invest, it doesn’t have to be in the stock market. It could be in more conservative investments. However, the stock market has been the best investment over the long run, and attempts by politicians to demonize it harm the American people,” Redpath said.

LP joins court case to remove limits on political speech
A lawsuit challenging the Federal Election Commission's (FEC) limits on how much people can contribute to political campaigns is on its way to the Supreme Court, and the Libertarian National Committee is supporting that challenge. The LNC has joined a coalition of other political groups in signing on to an amicus brief in the McCutcheon v. FEC case, which could finish the work began by Citizens United v. FEC in 2010, further abolishing restrictions on political speech expenditures. The U.S. Supreme Court agreed on Feb. 19 to hear the case in its upcoming term, late in 2013 or early in 2014.
The Libertarian Party has always stood firmly in favor of the fundamental right to freedom of speech and freedom of the press represented by the First Amendment to the Constitution. A right to free speech is nearly meaningless if it's not accompanied by the right to pay for the dissemination of one's views, which is why the LP platform calls for "the repeal of all laws which restrict voluntary financing of election campaigns."
McCutcheon v. FEC would reaffirm both the freedom of speech and the freedom of association in the context of political discourse, by removing the limit on individual and corporate direct contributions to political campaigns. Deregulating and repealing campaign finance laws are central to the Libertarian Party's advocacy of constitutional rights and a small, accountable government.

Most Americans want small government, says LP Executive Director Carla Howell
Republican and Democratic politicians support virtually identical policies designed to constantly escalate the scope and size of government, Libertarian Party Executive Director Carla Howell said in an interview featured Tuesday on the PressTV website. This stands in sharp contrast to the wishes of the vast majority of the American people.
"The Democrat and Republican politicians are no different," said Howell. "But the people who support them, the rank-and-file Republicans, are very much like Libertarians, and some Democrats are as well. Most Americans, across the board, want less government. They think government is too powerful, they think government's doing too much, and they think government is spending too much. And that's what the Libertarian Party is here for — to advocate to expressly reduce government power, government intrusion, government spending, and government foreign meddling."
Howell pointed out that politicians habitually use language that conceals their true intentions, misleading the voters who believe that government is far too large and powerful to support parties and political leaders to provide more of the same failed policies. Only the Libertarian Party has a consistent message of slashing government spending, shrinking debt and deficits, and eliminating the laws and bureaucracies that interfere with people’s lives and livelihoods.

Bill Slantz is ready to cut the size and scope of government drastically, and he's taking that message to the people of Missouri in his Libertarian Party campaign for a congressional seat representing the state's Eighth District. His first step: Abolishing the Department of Homeland Security (DHS), the Transportation Security Administration (TSA), the Environmental Protection Agency (EPA), the Drug Enforcement Administration (DEA), and the Internal Revenue Service (IRS).
"If elected, I will immediately sponsor legislation to eliminate the DHS (they have served their purpose), the TSA (let the airlines take care of their own security), the EPA, the DEA, and the IRS," Slantz wrote. "Also, I will immediately sponsor legislation to cut the budget of every other federal agency by 10 percent each year over the next four years."
