Libertarians won a long-fought ballot access victory in court on Friday over incumbent New York state Sen. Carl Marcellino (R-5th District).
Marcellino and several of his staffers sought to have their sole opponent on the ballot — Libertarain Gigi Bowman — removed from the ballot by filing a challenge to her qualifying petition. The 5th Senate district covers portions of Long Island's north shore in Suffolk and Nassau Counties.
On Sept. 29, the Nassau Supreme Court denied Bowman's motion to dismiss for late service, and granted her motion to transfer the case to Albany County. On Friday, Oct. 24, the New York Supreme Court, Appellate Division, Third Department, reversed that denial and ruled in favor of Bowman (Wilson et al. v. Bowman, 3rd Dept. Index No. 519828).

LP with coalition presses for real NSA reform
The Hill, Washington D.C.'s newspaper of record that focuses exclusively on politics, cited the Libertarian Party as one of the organizations in a pro–Fourth Amendment coalition that is lobbying to end government mass surveillance:
Dozens of civil liberties groups are calling on Congress not to stop short in reforming the National Security Agency.
The Bill of Rights Defense Committee led other organizations in a letter on Tuesday warning Congress against stopping with the USA Freedom Act, a bill currently in the Senate that would end the NSA's bulk collection of Americans' phone records.
Lawmakers should pass that bill 'and then immediately turn your attention to more meaningful and comprehensive reform of the [NSA's] overreaching and unconstitutional surveillance practices,' the groups wrote.
